Steep pharmaceutical price increases are a priority for policymakers on both sides of the Atlantic. European authorities have applied antitrust prohibitions on alleged "excessive pricing” by dominant companies to impose fines over $100 million. Lacking similar US antitrust rules, certain US states, such as Maryland, have introduced pharmaceutical price transparency and anti-pricegouging laws. These provide for notification of price increases exceeding a specified threshold and empower the state to impose civil penalties and enjoin “unconscionable increases”. This panel of US and EU enforcers, including the Maryland AG's office, and practitioners examine how the laws apply in the US and EU.
