The program's panels include:
• Ethics Update: Practitioners and United States Magistrate Judge Craig B. Shaffer will address recent developments concerning the attorney-client privilege and attorney work product doctrine.
• Cutting Edge Issues in Competing (Mineral) Property Rights: Practitioners and academics with in-depth experience and knowledge of the law as it relates to competing mineral property rights will address the current state of the rule of capture,the rule of reverse capture, and other related concepts as well as the interplay betweensurface rights holders and mineral rights holders when competing rights to different natural resources are at play.
• Recent Issues in Permitting and Challenges to Permitting: Practitioners who represent regulated entities, Wilderness Society and the U.S. Department of the Interior will address the current state of litigation concerning permitting decisions for energy and other projects, including possible impacts of policy changes by the Trump administration.
