CERCLA, now 35 years old, is experiencing a mid-life crisis challenging the legal reality and equitable standards upon which the allocation of site costs have traditionally been based. Superfund sites keep getting bigger, more complicated, and much more expensive to remediate, with several "mega-sites" approaching or breaching $1B remedial estimates, raising the financial stakes for even small percentage parties. Recent court rulings have challenged long-established understandings on divisibility, arranger liability, and the difference between cost recovery and contribution, shifting the underpinnings of traditional allocation practice. Large numbers of potential PRPs, diverse contamination, and inconsistent nexus data create substantial challenges in determining appropriate shares of site cost responsibility. This has led to a dramatic escalation in the use of scientific and technical experts in allocation efforts.
