The costs of prescription drugs continue to increase and some specialty drug costs are skyrocketing. Employers and plan sponsors attempt to control pharmacy spending by means of "pharmacy benefit manager" (PBM) agreements. On behalf of plan sponsors, PBMs negotiate with drug manufacturers and pharmacies and process prescription drug claims. While PBM arrangements have been beneficial to plans, negotiating and monitoring PBMs within the framework of ERISA's requirements, remains difficult given the complexity in drug pricing methodologies and PBM compensation (in particular, the lack of full disclosure of PBM indirect compensation such as price spreads). This webinar will discuss PBM agreements - what are they, what to look out for when negotiating them, transparency issues, hidden fees, and litigation. The webinar will also focus on specialty drugs, how they impact benefit consumption and plan design, and how to evaluate specialty drug vendors.

  • ERISA considerations when negotiating agreements and monitoring PBMs
  • PBM fees - rebates, price spreads, discounts, other payments
  • Litigation regarding fees and service providers
  • Specialty Drugs
