The long-awaited HIPAA Omnibus Rule was published in the Federal Register on January 25, 2013. It impacts patient privacy and data security under:
- The HIPAA Privacy, Security, and Enforcement Rules in order to include HITECH requirements;
- The Breach Notification Rule; and
- The Genetic Information Discrimination Act of 2008
The HIPAA Omnibus Rule's primary objectives are to increase health information privacy protections, to provide individuals with greater control over their own health information, and to strengthen the Office for Civil Rights' enforcement powers with respect to patient privacy and data security.
Understanding the fundamental compliance requirements under the HIPAA Privacy, Security, and Enforcement Rules and under HITECH and how these compliance requirements have been changed (or strengthened) as a result of the HIPAA Omnibus Rule is critical for healthcare attorneys and healthcare professionals.
